Right of Withdrawal for Sole Traders

Version 1.0 · Last updated: 16 October 2026

In brief. formexposed enters into contracts only with businesses, and businesses generally have no right of withdrawal. Polish law makes an exception for sole traders for whom the contract is not of a professional nature. If you belong to this group, you can withdraw from a contract for a paid plan within 14 days without giving reasons. Because the checkout does not currently ask for a request for immediate performance, we refund everything you have paid, without deduction, if you withdraw in time.

1. Who this page applies to

An account and the plans of formexposed are aimed exclusively at businesses that use the service for their commercial or independent professional activity. You confirm this when you register. Businesses have no statutory right of withdrawal; this page does not apply to them.

Polish law does, however, protect a certain group of businesses like consumers on certain points (Art. 38a of the Polish Consumer Rights Act, ustawa o prawach konsumenta, since 1 January 2021). This page applies to you only if all three conditions are met:

  1. you conclude the contract as a natural person, not on behalf of a company or a commercial partnership;
  2. you carry on a business activity; in Poland, it is registered in the Central Register and Information on Economic Activity (CEIDG). Whether sole traders without a CEIDG entry, for example from other countries, or partners in a civil-law partnership (spółka cywilna) can also rely on this protection has not been conclusively settled; in that case, write to us and we will examine it on a case-by-case basis;
  3. the contract with us is directly connected with your business activity, but according to its content it is not of a professional nature for you. This follows above all from the subject of your business activity as entered in the CEIDG.

An example

A photographer running a sole proprietorship uses formexposed to protect the contact form on her website. Web development and IT security are not part of her registered business activity; the contract is not of a professional nature for her, and she may be entitled to the right of withdrawal. A web agency whose registered business activity is building and maintaining websites, on the other hand, concludes the contract in its profession; it has no right of withdrawal.

Whether the conditions are met cannot be read from a checkbox. If you believe they apply to you, tell us so with your withdrawal; we will examine it on a case-by-case basis using the public CEIDG entry. For this group, this page takes precedence over the Terms of Service insofar as it gives them more extensive rights.

2. Which contracts

The right of withdrawal concerns the contract for a paid plan (Small, Pro or Business, monthly or annual) that you conclude through the checkout in the Billing area.

The free plan, which you receive when you register, costs nothing. Withdrawal would not lead to a refund there; you can end this contract at any time by deleting your account under Settings. This page does not apply to the free check without an account.

3. The withdrawal period

You can withdraw from the contract within 14 days without giving reasons (Art. 27 of the Consumer Rights Act). The period begins on the day the contract is concluded (Art. 28(2) of the same Act). The contract for a paid plan is concluded when you complete the checkout.

The day on which the contract is concluded is not counted; the period ends when the fourteenth day after it expires (Art. 111 § 2 of the Polish Civil Code, Kodeks cywilny, KC). If that day falls on a Saturday or a public holiday in Poland, the period ends on the next day that is neither a Saturday nor a public holiday (Art. 115 KC). Example: if you conclude the contract on Tuesday, 3 March, the period ends on Tuesday, 17 March, at midnight.

To meet the deadline, it is sufficient for you to send your declaration before the last day expires (Art. 30(2) of the Consumer Rights Act).

If we have not informed you about the right of withdrawal, the period ends only twelve months after the original 14 days have expired; if we provide the information within this time, it ends 14 days after we have done so (Art. 29 of the Consumer Rights Act). Before the purchase we refer to this information, with a link, in the Billing area and on our payment service provider’s checkout page; after the purchase we confirm the contract by e-mail, with the essential information on the right of withdrawal and a link to this page.

Trial period

The first purchase of a paid plan comes with a 14-day trial period for which you do not have to store a payment method. In that case too, the contract is concluded when you complete the checkout, and the withdrawal period begins on that day. It therefore runs essentially in parallel with the trial period and expires before the first payment is due.

If you do not store a payment method by the end of the trial period, the trial subscription ends automatically and no invoice is issued; no withdrawal is then needed.

Renewals

When a subscription renews for the next month or year, no new withdrawal period begins; it remains the same contract. To end a running subscription, you cancel it (section 8). If you buy a plan again after cancelling, that is a new contract with a new period; there is then no further trial period.

4. How to withdraw

No particular form is required for the withdrawal. What is needed is an unequivocal statement that you are withdrawing from the contract. You can use the model form in section 5 for this, but you do not have to. No reason is required.

  • E-mail to contact@lukaswojcik.com, preferably from the address of your account;
  • Support window (the question mark in the navigation), topic “Billing”, with the word “Withdrawal” at the start of the message;
  • Contact form at /contact;
  • Post to LW IT Solutions Company Lukas Wójcik, al. Tadeusza Kościuszki 80/82, lok. 301, 90-437 Łódź, Poland.

It helps us if you state the e-mail address of your account and your NIP or your name as entered in the CEIDG, so that we can identify the contract and check the conditions under section 1. This information is voluntary; the withdrawal is effective without it, and you also meet the deadline if we ask for it later.

We confirm receipt of your withdrawal by e-mail without undue delay.

Cancelling in the Billing area is not a withdrawal: it ends the subscription at the end of the paid period and does not trigger a refund. If you want to withdraw, write to us using one of the routes above.

5. Model withdrawal form

The following text reproduces the statutory model (Annex 2 to the ustawa o prawach konsumenta) unchanged; only our details as addressee have been inserted, as the model provides. The word “consumer” in the model refers here to you as an eligible sole trader. You do not have to use the form.

Model withdrawal form
(complete and return this form only if you wish to withdraw from the contract)

– To: LW IT Solutions Company Lukas Wójcik, al. Tadeusza Kościuszki 80/82, lok. 301, 90-437 Łódź, Poland, e-mail: contact@lukaswojcik.com

– I/We (*) hereby give notice that I/we (*) withdraw from my/our (*) contract of sale of the following goods (*), contract for the supply of the following goods (*), contract for specific work for the making of the following goods (*)/for the provision of the following service (*): ____________________

– Date of conclusion of the contract (*)/of receipt (*): ____________________

– First name and surname of consumer(s): ____________________

– Address of consumer(s): ____________________

– Signature of consumer(s) (only if this form is notified on paper): ____________________

– Date: ____________________

(*) Delete as appropriate.

If you wish, add the plan, the e-mail address of your account and your NIP outside the form (section 4). This is not necessary.

6. Effects of withdrawal

If you withdraw effectively, the contract is deemed not to have been concluded (Art. 31(1) of the Consumer Rights Act). We refund all payments we have received under this contract without undue delay, and no later than 14 days after receiving your declaration (Art. 32(1) of the Consumer Rights Act).

For the refund, we use the same payment method you used for the payment; the refund is made via our payment service provider Stripe. You incur no costs as a result. Because we do not deliver any goods, you do not have to send anything back; there are no return costs. How quickly your bank credits the amount is beyond our control.

With the withdrawal, the paid plan ends. Your account remains and continues on the free plan, with its limits. Anything beyond these limits, such as additional domains or channels, is then no longer available to you. If you want to give up the account entirely, delete it under Settings; before doing so, you can export your data there.

7. Immediate performance, pro rata compensation and expiry

The law allows a provider to perform a service before the withdrawal period has expired if the customer expressly requests it (Art. 15(3) and Art. 21(2) of the Consumer Rights Act). It attaches two consequences to this request:

  • If the customer withdraws afterwards, they owe an amount proportionate to the part of the service performed until the withdrawal, calculated on the basis of the agreed price; if that price is excessive, on the basis of the market value of the service performed (Art. 35 of the Consumer Rights Act).
  • In the case of a paid service, the right of withdrawal expires only if all three conditions are met: the provider has performed the service in full; it began doing so with the customer’s express and prior consent; and the customer was informed before the start that they would lose their right of withdrawal once the service had been performed in full, and acknowledged this (Art. 38(1)(1) of the Consumer Rights Act).

How it currently works at formexposed

The checkout of formexposed does not ask for such a request. Your plan can be used as soon as you complete the checkout, but in doing so you have neither expressly requested immediate performance nor confirmed that you may lose your right of withdrawal.

For you, this means:

  • No deduction. If you withdraw in time, you pay nothing for the period in which you have already used the plan, and we refund the full amount (Art. 36(1)(b) of the Consumer Rights Act). This also applies to an annual plan that you have paid in advance.
  • No early expiry. Your right of withdrawal does not expire early because we are already performing the service. It ends when the period under section 3 expires.

Should the checkout ask for such a request in future, we will change this page beforehand. For contracts concluded before the change, what is stated here continues to apply.

8. Withdrawal and cancellation are two different things

After a cancellation, your account continues on the free plan. The details of the term and cancellation are set out in the Terms of Service.

9. What else applies to you

In addition to the right of withdrawal, sole traders under section 1 are protected against unfair contract terms (Art. 385⁵ of the Polish Civil Code, Kodeks cywilny, KC). What this means for disputes and the place of jurisdiction, and how to complain, is set out on the Complaints page. Other mandatory rights remain unaffected by this page.

We do not take part in dispute resolution proceedings before a consumer arbitration board. The European Online Dispute Resolution platform ceased operating on 20 July 2025.
